The Amendment to the Employment Relationships Act Slovenia, effective November 16, 2023, introduces significant improvements to working conditions and legal security for workers.

Right to Disconnect

Employees can now prevent employers from contacting them during rest periods, annual leave, or justified absences. Employers must ensure this right.

Protection of Workers’ Representatives

Workers’ representatives gain increased legal protection against dismissal. The labour court can now suspend the effects of dismissal until it makes a decision. This suspension can last up to six months.

Compensation for Agency Workers

Compensation for agency workers increases from 70% to 80% of their salary when work is not provided. Therefore, agencies must adjust payroll accordingly.

Probationary Work

Probationary work duration is now proportionate to the employment contract’s length.

Work-Life Balance

Employees can propose different working hours for better work-life balance. Employers must respond in writing within 15 days.

Support for Domestic Violence Victims

Victims can work part-time and receive up to five paid leave days for necessary arrangements. Proof must be provided to employers.

Grounds for Extraordinary Termination

Employees can now terminate contracts if employers fail to pay compensation. Employees could not take this action previously, however, now it ensures fair treatment. This change significantly benefits employee rights.

Shorter Period for Repeat Offences

The period to avoid repeat offences after a written warning is reduced from one year to six months.

Leave for Childcare

Employees with children up to eight years old can propose part-time work to balance professional and private life.

Carers’ Leave

Employees can take five days of leave per year to care for family members. They must notify the employer and provide evidence.

Part-Time Work for Caregivers

Employees caring for children or sick/elderly family members can propose part-time work. Employers must respond in writing within 15 days.
