The idea of machines performing tasks that require human-like intelligence, such as learning and problem-solving, has moved from the realm of science fiction to everyday reality. The rapid development of artificial intelligence technology, exemplified by platforms like ChatGPT—which launched on 30th November 2022 and quickly reached 100 million users—illustrates just how fast AI is evolving.

Given the breakneck speed of AI innovation, there’s widespread agreement among developers and policymakers that robust regulation is crucial. Yet, the challenge lies in keeping up with such a swiftly changing landscape.

What is the Current AI Legislation in the UK?

Although recent reports place the UK as a global leader in AI development, ranking third behind the US and China, the country currently lacks a dedicated, comprehensive legal framework for AI. Instead, the UK relies on existing laws, such as the UK GDPR, which touch on aspects of AI but do not directly address the technology’s unique challenges.

Recognising this gap, the UK Government published an AI White Paper on 29 March 2023, outlining its proposed approach to this regulation. The White Paper remained open for consultation until 21 June 2023, marking the first significant step toward a bespoke regulatory framework.

A Balanced Approach: The Government’s Vision

From the Government’s AI White Paper, it’s evident that they are striving to find a balance. Regulation must support innovation while safeguarding consumers and ensuring ethical use of artificial intelligence. The Government aims to establish a flexible and adaptable framework, underpinned by five key principles to guide AI’s responsible development and deployment:

  2. Transparency and Explainability
  3. Fairness
  4. Accountability and Governance
  5. Contestability and Redress

What Could Enforcement Look Like?

Instead of creating a single AI regulator, the UK Government seems to favour a sector-based, regulator-led model. This approach would involve leveraging existing regulatory bodies such as the Information Commissioner’s Office (ICO), Competition and Markets Authority (CMA), Financial Conduct Authority (FCA), and the Human Rights Commission. These regulators would be responsible for ensuring that AI use within their sectors adheres to the guiding principles outlined above.

While the regulators agree in principle, a significant challenge will be coordinating efforts to maintain consistency across sectors. Over the coming year, these bodies are expected to issue non-statutory guidance, including risk assessment protocols, to help navigate this evolving landscape.
